Container Re-use Service Terms and Conditions
By using the Container Re-use Service or any portion thereof, the Customer agrees to be bound by the following terms and conditions (the “Container Re-use Service Terms”).
The Customer may, at the time of requesting a quotation, subscribe to the Container Re-use Service for “Eligible Shipments” (as defined below), subject to the Container Re-use Service Terms. The Customer shall at all times comply with the Container Re-use Service Terms as well as all other applicable terms and conditions, including the OOCL Global Rule Tariff set at the carrier’s prevailing governing tariffs on www.oocl.com, and terms and conditions governing the FreightSmart services.
For shipments to be eligible for the Container Re-use Service (“Eligible Shipments”), the following conditions shall be met:
The use and provision of the Container Re-use Service shall be subject to the terms of OOCL Rule Tariff E-34 (available to check at Rule Tariff Search), which are expressly and fully incorporated in these Container Re-use Service Terms.
The Customer can subscribe to the Container Re-use Service in the E-Spot ordering stage. The service will only be available to the Customer specifically for the containers carried under the confirmed booking of Eligible Shipments, and receiving written approval from OOCL for the re-use of OOCL equipment.
The following Container Re-use Service features will become available to the Customer specifically for the containers carried under the confirmed order of Eligible Shipments, for which the Container Re-use Service has been subscribed by the Customer and confirmed by OOCL:
Unless advised otherwise by OOCL, the Container Re-use Service fee is due and payable together with Ocean Freight in the invoice.
The Customer guarantees compliance with all applicable laws, rules, and regulations relevant to the use/re-use of the containers.
The Customer agrees to defend, indemnify, and hold harmless OOCL and all Related Parties from losses arising from any breach of the Container Re-use Service Terms or legal non-compliance.
OOCL shall use commercially reasonable efforts to provide accurate information. Some content may be subject to change and is not guaranteed. The Bill of Lading Terms and Conditions shall prevail over any conflicting terms.
The Container Re-use Service Terms shall be governed by English Law.
OOCL reserves the right to amend these Container Re-use Service Terms without prior notice.
